Definitions

In these Conditions:

"Goods" means all or any goods works materials and products to be supplied by Design Extreme Sports

Conditions of Web-Site Use

No contact will subsist between you and us for the sale by us to you of any Goods unless and until we accept your order by e-mail confirming that the Goods have been dispatched. That acceptance shall be deemed for all purposes to have been effectively communicated to you at the time we send the e-mail to you (whether or not you receive that e-mail). For the avoidance of doubt, any such contract will be interpreted, construed and enforced in all respects in accordance with the laws of England, and the parties irrevocably submit to the exclusive jurisdiction of the English courts.

Orders

Orders can be made by telephone or online and payments may be made by cheque or by credit card through Paypal.

Deliveries

We will dispatch goods using Royalmail.

A signature may be required upon receipt of the Goods. The boxes containing the Goods should be in good condition before signing. Any transport damages must be reported immediately to us in order that we may make a claim and send a replacement.

Risk and Title

Risk and title in the Goods will pass to you on delivery notwithstanding that property in the Goods may not have passed to you.

Notwithstanding delivery and the passing of risk, legal and beneficial title to the Goods shall remain in our name until we have received payment of the full price for the Goods.

Returns

A full refund can only be given for Goods if they are returned to us in unused undamaged condition. We will not be responsible for carriage charges on Goods returned.

Warranties

All our Goods and their components are warranted against manufacturing defects for one year- this does not cover third party items. Please note that damage caused by either (a) mis-use or (b) normal wear and tear of components such as bearings, elastomers or decks is not covered. Please note that the Goods should only be used on a flat even surface and we strongly recommend that this should be the only surface used.

To the fullest extent permitted by the law, we are providing this web-site and its contents on an "as is" basis and make no (and expressly disclaims all) representations or warranties of any kind, express or implied, with respect to this web-site or the information, content, materials or products included in this site including, without limitation, warranties of merchantability and fitness for a particular purpose. In addition, whilst we make efforts to ensure the accuracy of information provided, we do not represent or warrant that the information accessible via this web-site is accurate, complete or current. Price and availability is subject to change without notice.

Total liability in respect of any claim howsoever arising shall be limited to the price paid by you for the Goods. In no circumstances shall we be liable to you in contact tort (including without limitation negligence) and/or breach of statutory duty for any loss of profits, loss of business or depletion of goodwill or for any indirect or consequential (including economic) loss of any kind.

We cannot be held responsible for any accidents resulting in loss or damage to yours or others property, however caused. Please observe all the safety precautions and ensure that you are riding within your own capabilities. Always ride with protective gear and suitable clothing. The bare minimum of helmets, wrist guards, knee pads, elbow pads and supportive boots should be worn at all times ensure that all gear is of the correct size, always check the tightness of bolts and ensure the condition of your board and protective gear is satisfactory before riding.

Notwithstanding this disclaimer nothing in these conditions will be construed or operate so as to exclude or restrict our liability for death or personal injury caused to you by reason of our negligence or that of our employees.
